DARMSTADT, Germany — A German singer facing accusations that she infected a man with the virus that causes AIDS acknowledged in court Monday that she had unprotected sex despite knowing she was HIV-positive.
The 28-year-old Nadja Benaissa, a member of German girl band No Angels, is charged with grievous bodily harm for allegedly infecting a partner with the virus in 2004 and also faces charges of attempted bodily harm for having unprotected sex with two other men.
"I am sorry from my heart," she said in a statement read by her lawyer to the Darmstadt administrative court. "No way did I want my partner to be infected."
The man who claims Benaissa infected him says they had a three-month relationship at the beginning of 2004, and that he got tested after Benaissa's aunt asked him in 2007 whether he was aware that the singer was HIV-positive.
Prosecutors say Benaissa had known she was HIV-positive since 1999.
Benaissa was arrested in April 2009 and kept in custody for 10 days – a move that a German AIDS awareness group criticized as disproportionate. The Deutsche AIDS-Hilfe group argued that the question of whether her partners also carried a share of the responsibility had been neglected.
Benaissa joined No Angels in 2000 through the TV casting show "Popstars." The group sold more than 5 million albums before breaking up in 2003.
Benaissa helped reform the group in 2007 with three other members. The group represented Germany in the 2008 Eurovision song contest.

I believe she is North African in ancestry, looks straight up mulatta. I know her mother is Roma (Gypsy).

If she knew she was infected when she slept with him and he dies as a result she should at least be charged with manslaughter or whatever the German equivalent law is regarding indirectly causing a person to die.

Her excuse was that she was high on drugs and didn't know what she was doing...oh well, if you are high on drugs and kill someone with your car, no one cares if you "knew what you were doing"...

Its not a similar situation. A driving death is cut and dried. Most people with HIV live a long long time these days with the advances in drugs. What she's done rather than killing him is caused him to have to take a series of medication for the rest of his life. She may have shortened his lifespan, but as long as he is able to get treated, shes really just cost him money and time.

Why would the stripper agree to have unprotected sex with the guys especially when she knew she had HIV? If someone asked you to point a revolver at their head with one bullet in it and pull the trigger, would you not be guilty if you killed him?
The dancer was legally responsible to tell the men that she was HIV infected, but she failed to do that. Either she didn't care if the men got infected, or she wanted some kind of revenge. Whatever the reason, she committed a crime, not the men.
The court has found her guilty of attempted battery (or is the correct term assault?), and she is in prison now waiting for a mental examination. The final sentence will come later.

It is not comparable, because getting infected with HIV does not kill you instantly. While it may shorten your life by some years, someone with HIV may well live up to the age of 70 with proper treatment. A man who gets HIV from having unprotected sex with a stripper may already have children and has plenty of time to conceive more. Nothing gets selected there, so it is not natural selection.

God... I keep hearing more of these stories of people knowingly spreading AIDS... so disgusting. There was one here in the US involving some young white American prostitute (I made a thread on it). And there was another case where some older gay guy flew in some teenager he met via the net and had sex with him multiple times and never informed him that he was HIV+ until after... :| (the young guy is now HIV+ and the older guy is still under trial I believe).
If I ever found out that any of my sexual partners was aware that they had AIDS but failed to inform me (even though I pretty much always use protection)..... I'd kill the bitch! Even if I didn't get infected... I'd still choke a bitch! :lol:
